These general terms of sale (« Terms ») apply to the DJ, sound and lighting services and associated services (live performances, artistic direction) offered by Thibault Lagrabette, sole trader (micro-entreprise), trading as THIBAULT L EVENT (SIRET 844 534 396 00016, 7 avenue du Vallon, 33600 Pessac, France, contact@thibaultlevent.com), hereinafter « the provider », for private or professional events.
They are given to the client before the quote is signed and can be consulted at any time on the site.
A « consumer » is a client who is an individual acting for non-professional purposes (for example for their wedding), and a « professional client » is a client acting in the course of their business (company, association, venue).
1. Purpose and acceptance
These Terms govern the relationship between the provider and their client. Signing the quote constitutes full and unreserved acceptance of the Terms, which the client acknowledges having read before signing.
2. Quote, booking and payment
Quote. Each service is the subject of a written quote stating the services, the date, the venue, the times and the price. The provider benefits from the VAT exemption scheme: VAT not applicable, Article 293 B of the French General Tax Code.
Booking. The booking becomes firm and final on receipt of the signed quote together with payment of a 50% deposit of the total amount of the service.
Nature of the deposit. The sums paid at booking are a deposit (« acompte ») and not earnest money (« arrhes »): they firmly commit both parties, the client as well as the provider.
Balance. The balance is paid in the week preceding the service, and at the latest on the day of the service before it begins, unless the parties have agreed otherwise in writing.
The accepted payment methods are stated on the quote.
3. Cancellation and withdrawal
Cancellation by the client. The client informs the provider of the cancellation in writing (email). In case of cancellation, for any reason other than force majeure (Article 4), the deposit paid remains with the provider and is not refunded. It compensates, on a flat-rate basis, the loss suffered by the provider, who reserved the date and turned down other requests. The balance is not due if the cancellation takes place before its due date.
Cancellation by the provider. If the provider cancels the service, all sums paid by the client are refunded as soon as possible, subject to the replacement solution offered in Article 8, which the client may accept or refuse.
4. Force majeure
Neither party is liable for a failure or delay in performance caused by an event of force majeure within the meaning of Article 1218 of the French Civil Code and French case law.
In this case, the parties get together to find an amicable solution: postponing the date, adapting the service or, where applicable, refunding the sums corresponding to the part of the service not performed.
5. Running of the service
Any request for overtime is made to the DJ at least 30 minutes before the planned end time, subject to availability, at the rates that the provider communicates to the client before the overtime is worked. The service ends at 4 a.m. at the latest. Exceptionally, and only with the provider's prior written agreement, it may be extended until 5 a.m.
6. Meals and hospitality
Unless the quote states otherwise, the client undertakes to provide the DJ, and any person accompanying them or their team, with a hot meal and non-alcoholic drinks, under conditions similar to those of the guests. The provider informs the client in advance of whether or not someone will be accompanying the DJ.
7. Equipment, liability and insurance
The client is responsible for the safety of the provider's equipment present at the event venue, from its installation until it is collected, except in case of fault or negligence by the provider.
In case of theft, damage or deterioration of this equipment, the client compensates the provider up to the cost of repair or, if repair is impossible, of identical replacement, on presentation of supporting documents.
The client checks that their public liability insurance covers the event, or takes out a policy with the insurer of their choice.
The provider is liable, under the ordinary rules of law, for damage caused by their fault in performing the service.
8. Replacement of the DJ
In case of a major unforeseen event preventing the DJ originally planned from performing the service, the provider offers an equivalent replacement solution, provided by a professional DJ working with the provider who meets the same quality requirements.
The client may refuse this replacement. They are then fully refunded the sums paid.
When the service is performed by a collaborating DJ, it remains due and is paid exclusively to Thibault Lagrabette: the client pays nothing directly to the collaborating DJ. The provider undertakes not to disclose any financial information about the client to third parties.
9. Right of withdrawal (consumers)
The consumer client is informed that they do not have the 14-day right of withdrawal for leisure activity services to be provided on a specific date (Article L221-28, 12° of the French Consumer Code). The services covered by these Terms are provided on the date stated on the quote. By signing the quote, the client acknowledges having been informed that there is no right of withdrawal.
10. Professional clients: late payment
For professional clients, any sum not paid by the due date automatically bears interest at a rate equal to three times the legal interest rate, without prior formal notice, and gives rise to a flat-rate recovery fee of €40. No discount is granted for early payment.
11. Personal data
The client's personal data is processed as described in the Privacy policy.
12. Consumer mediation
If the client is a consumer, they may, after first sending a written complaint to contact@thibaultlevent.com that has remained without a satisfactory reply, use the following consumer mediator free of charge:
- Mediator: [[À FOURNIR : nom du médiateur de la consommation auprès duquel Thibault a adhéré]]
- Postal address: [[À FOURNIR : à renseigner une fois le médiateur choisi]]
- Website: [[À FOURNIR : à renseigner une fois le médiateur choisi]]
Using mediation is not compulsory and does not deprive the client of the right to bring the matter before a court.
13. Applicable law and competent court
These Terms are governed by French law.
In case of dispute, the parties first seek an amicable solution.
Failing agreement, for professional clients, the courts of Bordeaux have sole jurisdiction. For consumer clients, the dispute falls within the courts having jurisdiction under the legal rules, the consumer being able in particular to bring the matter before the court of the place where they live or of the place of the service.
